Extended Producer Responsibility

Producer responsibility applies to approximately 50,000 Finnish manufacturers, importers and packers as well as distance sellers.

Non-compliance with Extended Producer Responsibility can result in a substantial fine.  

Meeting Extended Producer Responsibility obligations is not voluntary. If a company which has responsibility as a producer neglects its registering responsibility, the Pirkanmaa ELY Centre may impose a negligence fine:  

  • the fine is 1% of the company's turnover in the previous year 
  • However, the fine must be a minimum of EUR 500 and a maximum of EUR 500,000.  
     

A fee may also be imposed for failure to report monitoring data, which is at least EUR 500 and at most EUR 10,000.  

Before the fine is imposed, the negligent party is requested, in writing, to rectify its negligence.

Joint supervision by the authorities 

The Pirkanmaa ELY Centre oversees and supervises the implementation of producer responsibility nationwide, with the exception of Åland. Monitoring ensures that all companies under producer responsibility participate in the organising and costs of waste management. The Pirkanmaa ELY Centre cooperates with other authorities such as the Tax Administration, Customs and the Finnish Environment Institute. 

Producers and producer organisations included in the producer register must report the quantities of products placed on the market as well as the quantities collected and recycled to the ELY Centre annually. Companies belonging to a sector-speci c producer organisation report their data to the organisation. Producers must meet recycling and recovery requirements. Based on the reported data, the Pirkanmaa ELY Centre compiles national statistics on producer responsibility and reports them to the European Commission for most sectors. 

Supervision ensures that there is a sufficiently large and frequent collection network for waste covered by Extended Producer Responsibility, to which consumers can return discarded products free of charge. Producers and producer organisations are obliged to provide information on collection and recycling. This will also be supervised.
